These Terms of Service (“Terms”) govern your access to and use of shamaninside.com (the “Site”) and any purchases made through the Site.

Throughout these Terms, “Shaman Inside,” “we,” “us,” and “our” refer to the operator of shamaninside.com.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products to you.

By accessing the Site, placing an order, or otherwise using our services, you agree to these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

If you do not agree with these Terms, you should not use the Site or place an order.

Nothing in these Terms limits or excludes any mandatory rights you may have under applicable consumer protection law.

Shaman Inside is a creative brand offering Print on Demand products featuring original designs, including designs inspired by animals, symbolism and spirit-guide concepts.

We use third-party production and fulfillment providers, including Printify and its network of Print Providers, to manufacture and ship our products.

Your purchase contract is with Shaman Inside, not with Printify or the individual Print Provider fulfilling your order.

2. Eligibility and Use of the Site

By using the Site or placing an order, you confirm that you have the legal capacity to enter into a binding contract under the laws applicable to you.

If you are under the age of legal majority in your jurisdiction, you may only use the Services with the involvement or authorization of a parent or legal guardian where required by law.

You agree not to use the Site or our products for any unlawful or unauthorized purpose.

You must not:

  • interfere with the operation or security of the Site;

  • attempt to gain unauthorized access to systems or accounts;

  • introduce viruses, malware or other harmful code;

  • use automated systems to scrape or extract Site content without authorization;

  • infringe our intellectual property rights or those of others;

  • use the Services in violation of applicable law.

3. Products and Print on Demand Production

Most products sold by Shaman Inside are produced using a Print on Demand model.

This means that products are generally manufactured after your order has been placed rather than being held as finished inventory.

Production may be performed by different Print Providers depending on factors such as:

  • product type;

  • availability;

  • destination;

  • production capacity;

  • fulfillment requirements.

Production and fulfillment times may therefore vary between products and orders.

4. Product Images, Colors and Variations

We make reasonable efforts to display product descriptions, images, colors, sizes and other characteristics as accurately as possible.

However, colors displayed on your screen may vary depending on your device, display settings and lighting conditions.

Because products are individually manufactured and printed, minor variations in print placement, color appearance, texture or other production characteristics may occur.

Such minor variations do not automatically indicate a manufacturing defect.

Nothing in this section affects your rights where a product is defective, materially different from its description or otherwise non-conforming under applicable law.

Please review product descriptions and size guides carefully before placing an order.

5. Orders and Contract Formation

By submitting an order through the Site, you offer to purchase the selected products in accordance with these Terms.

You are responsible for ensuring that all information provided during checkout is accurate and complete.

After an order is submitted, you should receive an order confirmation.

We reserve the right, where legally permitted, to reject or cancel an order for legitimate reasons, including:

  • suspected fraud or unauthorized payment activity;

  • incorrect pricing caused by an obvious technical error;

  • product or production unavailability;

  • inability to fulfill the order;

  • shipping restrictions;

  • violation of these Terms;

  • legal or regulatory restrictions.

If we cancel an order after payment has already been collected, we will refund the amount due using the applicable payment method.

We may also limit quantities where reasonably necessary, including to prevent fraud, unauthorized resale or abuse of promotional offers.

6. Order Changes and Cancellations

Print on Demand orders may enter production shortly after payment is confirmed.

We will make reasonable efforts to process your request before production begins.

Once production has started, it may no longer be technically possible to modify or cancel the order through our fulfillment provider.

This does not limit any mandatory cancellation or withdrawal rights available to consumers under applicable law.

7. Prices

Product prices are displayed on the Site and may vary depending on:

  • product;

  • size;

  • color;

  • variant;

  • destination;

  • applicable promotions.

We reserve the right to change prices at any time. Price changes will not normally affect orders already accepted by us, except in cases of an obvious pricing or technical error where permitted by law.

The price applicable to your purchase will be displayed during checkout before you submit your order.

8. Taxes, VAT and Customs Charges

Depending on your location, order value and applicable law, your purchase may be subject to:

We do not guarantee that every payment method will be available in every country.

Shipping methods, costs and estimated delivery times vary according to factors including:

  • Print Provider;

Estimated delivery times are provided for guidance and are not guaranteed unless expressly stated otherwise.

Orders containing multiple products may be fulfilled by different production facilities and may therefore arrive in separate packages or at different times.

Delays may occur because of circumstances outside our reasonable control, including:

  • carrier delays;

  • customs processing;

  • severe weather;

  • public holidays;

  • peak demand periods;

  • production disruptions;

  • incorrect or incomplete delivery information.

Nothing in these Terms limits any mandatory rights relating to delivery deadlines under applicable consumer law.

11. Shipping Address

You are responsible for providing a complete and accurate shipping address.

Please verify all shipping information carefully before submitting your order.

We will attempt to correct the address where technically possible.

Once an order has entered production or shipping, we cannot guarantee that the address can be changed.

Additional production or shipping charges may apply where an order must be reproduced or reshipped because the customer provided an incorrect or incomplete address, to the extent permitted by applicable law.

12. Returns, Exchanges and Refunds

Our complete rules regarding returns, exchanges and refunds are contained in our Returns & Refunds Policy, which forms part of these Terms.

Because most Shaman Inside products are produced on demand, our commercial return policy for non-defective products may differ from that of retailers holding finished inventory.

For customers in jurisdictions where no mandatory right of withdrawal applies, including many purchases made by customers in the United States, we generally do not accept returns or exchanges for non-defective Print on Demand products solely because of:

  • change of mind;

  • an incorrectly selected size;

  • an incorrectly selected color;

  • preference for another design or variant.

This restriction does not affect rights that cannot legally be excluded.

13. European Consumer Withdrawal Rights

If you are a consumer located in the European Union or another jurisdiction providing mandatory withdrawal rights for distance purchases, those rights remain fully applicable where required by law.

For qualifying EU distance purchases, consumers generally have a 14-day statutory withdrawal period, subject to applicable legal exceptions.

Certain goods made to the consumer's specifications or clearly personalized may be excluded from the statutory withdrawal right where the applicable law provides such an exception.

The fact that an item is produced using a Print on Demand process does not by itself necessarily mean that the item is legally considered personalized.

Nothing in these Terms is intended to restrict mandatory consumer withdrawal rights.

14. Damaged, Defective or Incorrect Products

If you receive an item that is damaged, defective, incorrectly manufactured or different from the product you ordered, please contact us as soon as possible at:

Our standard production-issue procedure asks customers to report manufacturing problems preferably within 30 days of delivery and to provide appropriate photographic evidence.

Depending on the circumstances, an eligible issue may be resolved through:

  • replacement or reprint;

  • refund;

  • another remedy required by applicable law.

The 30-day reporting procedure is our standard commercial process for production issues and does not limit any longer statutory guarantee or legal conformity rights that may apply to you.

Do not send defective products directly to Printify or to the return address shown on a shipping label unless we specifically instruct you to do so.

15. Statutory Consumer Rights

Nothing in these Terms excludes, restricts or modifies any mandatory consumer rights that cannot legally be excluded.

This includes applicable rights relating to:

  • product conformity;

  • defective products;

  • delivery;

  • refunds;

  • statutory guarantees;

  • withdrawal rights;

  • consumer remedies.

Where these Terms conflict with mandatory consumer protection law applicable to you, the mandatory law will prevail.

16. Intellectual Property

Unless otherwise stated, all content made available through the Site is owned by or licensed to Shaman Inside.

This may include:

  • artwork;

  • designs;

  • illustrations;

  • product graphics;

  • photographs;

  • logos;

  • brand names;

  • trademarks;

  • text;

  • website graphics;

  • layout;

  • creative concepts.

The purchase of a physical product does not transfer ownership of the intellectual property contained in or associated with its design.

You may not, without prior written permission:

  • copy our designs;

  • reproduce them;

  • modify them for commercial use;

  • distribute them;

  • sell or license copies;

  • use them on other products;

  • use them to create derivative commercial products;

  • scrape or systematically reproduce Site content.

Products purchased from the Site may be used for normal personal purposes unless otherwise stated.

Nothing in these Terms transfers intellectual property rights to you except for the limited right to use the purchased physical product.

17. User Submissions and Communications

If you voluntarily submit reviews, feedback, comments, photographs or other content to us, you confirm that you have the right to provide that material and that it does not unlawfully infringe the rights of another person.

We may use feedback submitted specifically about our products or Services for legitimate business purposes, subject to applicable law and our Privacy Policy.

We will not claim ownership of intellectual property that remains legally yours merely because you communicate with us.

18. Third-Party Services

Our Site relies on services provided by third parties, including Shopify, Printify, payment providers, shipping carriers and other technology providers.

We are not responsible for third-party websites or services that are outside our control.

Links to external websites are provided for convenience and do not necessarily constitute an endorsement.

Your use of third-party websites or services may be governed by their own terms and privacy policies.

This section does not affect our responsibility to you as seller where applicable law makes us responsible for fulfilling our obligations under your purchase contract.

19. Availability of the Site

We aim to keep the Site available and functioning properly, but we cannot guarantee uninterrupted or error-free access at all times.

Access may occasionally be interrupted because of:

  • maintenance;

  • technical problems;

  • security issues;

  • updates;

  • failures involving third-party infrastructure;

  • circumstances outside our reasonable control.

This does not affect orders already accepted or rights you have under applicable law.

To the maximum extent permitted by applicable law, Shaman Inside will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the contract was entered into.

We are not responsible for losses caused exclusively by:

  • misuse of a product;

  • failure to follow product instructions or warnings;

  • information incorrectly provided by the customer;

  • events outside our reasonable control;

except where applicable law provides otherwise.

Any limitation in this section applies only to the extent permitted by the law applicable to you.

23. Force Majeure

We will not be responsible for delay or failure to perform an obligation where that delay or failure results from circumstances beyond our reasonable control, such as:

  • natural disasters;

  • severe weather;

  • war;

  • civil unrest;

  • government restrictions;

  • transportation disruptions;

  • widespread carrier interruptions;

  • telecommunications failures;

  • major production disruptions.

Where such an event affects an order, we will take reasonable steps to minimize the impact and comply with any mandatory rights you may have under applicable law.

Your submission of personal information through the Site is governed by our Privacy Policy.

constitute the agreement governing your use of the Site and purchases from Shaman Inside, subject to any additional mandatory rights provided by applicable law.

29. Governing Law and Jurisdiction

These Terms and contracts entered into through shamaninside.com are governed by the laws of Italy, subject to applicable conflict-of-law rules and mandatory consumer protection laws.

If you are a consumer residing in the European Union, European Economic Area, United Kingdom or another jurisdiction providing mandatory consumer protections, this choice of law does not deprive you of any mandatory protections granted by the law that would otherwise apply to you.

Nothing in these Terms requires a consumer to bring a claim exclusively before the courts of Rome where applicable law gives the consumer the right to bring proceedings before another competent court.

For disputes that are not subject to mandatory consumer jurisdiction rules, the courts competent under applicable law will have jurisdiction.
